By accessing and using Showtiva ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this Service.

These Terms of Service ("Terms") govern your use of our voting platform, including all content, services, and products available at or through the Service, operated by Showtiva.

Showtiva is a digital voting platform that enables organizations to create and manage voting events, including contests, awards ceremonies, and elections. The Service allows:

• Event organizers to create and manage voting events
• Users to participate in voting events
• Payment processing for paid voting events
• Real-time analytics and reporting
• White-label subdomain hosting

Account Creation

To use certain features of our Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

Account Types

We offer different account types:

• Voter Accounts: For participating in voting events
• Organizer Accounts: For creating and managing events and organizations

Account Termination

We reserve the right to terminate or suspend your account at any time for violations of these Terms or for any other reason at our sole discretion.

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit any harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Create fake accounts or manipulate voting results
• Use automated systems to interact with the Service
• Engage in any fraudulent payment activities
• Harass, abuse, or harm other users
• Spam or send unsolicited communications

Voting Rules

• All votes are final and cannot be changed or refunded once cast
• Vote manipulation or fraud is strictly prohibited
• Each user may vote according to the rules set by event organizers
• Voting periods are determined by event organizers

Payment Processing

• Payments are processed securely through Paystack
• All payments are in Nigerian Naira (NGN)
• Payment failures do not result in vote casting
• Refunds are subject to our refund policy and event organizer approval
• Platform fees are automatically deducted from organizer payments

Revenue Sharing

For paid events:

• Event organizers receive 97% of vote payments
• Paystack deducts 1.5% as platform commission and an additional 100 NGN for transactions greater than 2,000 NGN
• Showtiva retains 1.5% as platform commission
• Payments are automatically split through Paystack subaccounts
• Settlement schedules follow Paystack's standard terms

Our Content

The Service and its original content, features, and functionality are and will remain the exclusive property of Showtiva and its licensors. The Service is protected by copyright, trademark, and other laws.

User Content

You retain ownership of content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with the Service.

Trademark Policy

Showtiva and related logos are trademarks of our company. You may not use our trademarks without our prior written consent.

Service Availability

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, Showtiva shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses.

Event Organizer Responsibility

Event organizers are solely responsible for their events, including content, rules, and compliance with applicable laws. Showtiva is not responsible for the conduct of event organizers or the outcomes of voting events.

These Terms shall be governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in Lagos, Nigeria, or through the competent courts of Nigeria.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
